Public offer
For entering into a retail sale and purchase agreement for Catelier goods
Revision dated 30 October 2026
1. General provisions
1.1. Individual entrepreneur Предводителева Ніколь (Nikol Predvodyteleva), taxpayer registration number (РНОКПП) 3506103807, hereinafter the “Seller”, who manufactures and sells goods under the Catelier name, offers individuals purchasing goods for personal needs, hereinafter the “Buyer”, an agreement on the terms below.
1.2. The online store operates at https://catelier.com.ua. This offer also applies to distance orders through the store's official contacts on Viber, Telegram, by email and telephone, provided that these terms are made available to the Buyer before acceptance.
1.3. The agreement is governed by Ukrainian legislation, including the Civil Code of Ukraine and the Laws of Ukraine “On Electronic Commerce” and “On Consumer Rights Protection”. This offer is intended for retail sales to consumers in Ukraine.
1.4. The offer applies from publication until it is withdrawn or replaced by a new version. The version accepted by the Buyer when entering into the agreement applies to the order. Subsequent changes do not alter that order's agreed terms without the parties' consent.
2. Goods and their characteristics
2.1. The Seller manufactures and sells goods for cats: shelves, scratching posts, houses, stairs and other products for the corresponding purposes. Materials may include plywood, sisal, carpet and a wood-stain finish. The composition and finish are specified for each model.
2.2. The model, dimensions, colour, materials, quantity, price, contents of the set, mounting components, assembly requirements and other characteristics are stated on the product page, in the options selected by the Buyer and in the order confirmation. The specific set of parts and fixings depends on the model.
Before the order is accepted, the Buyer may clarify these characteristics with the Seller.
2.3. Plywood may have natural variations in wood grain, texture and shade; a wood-stain finish may look different on different areas of the material. Such variations are acceptable if they match the product description and agreed colour and do not impair strength, safety or suitability for use.
Cracks, delamination, dangerous splinters and other defects are not deemed acceptable solely because of the material's natural origin.
2.4. The colour shown in photographs may depend on lighting and screen settings. This does not release the Seller from the obligation to supply goods matching the agreed description.
Any permitted dimensional tolerances, where applicable to a product, are communicated before the order is agreed; this offer does not grant a general right to alter dimensions arbitrarily.
2.5. Before sale and with the goods, the Seller provides the legally required information about itself as manufacturer, the product's characteristics and completeness, safe assembly, installation, use, care and applicable warranty terms.
For wall-mounted and load-bearing structures, the permitted load, the conditions under which it applies and the mounting requirements for the specific model are communicated.
3. Ready-made and made-to-order goods
3.1. The Buyer may purchase ready-made goods from stock or goods manufactured after ordering. Availability and the need for manufacture are communicated before the offer is accepted.
3.2. Product parameters are selected on the product page and, where necessary, clarified through Viber, Telegram, email or telephone. For manufacture to individual specifications, the parties agree on the characteristics, contents, price, payment method and dispatch deadline before work begins.
A sketch or another description is agreed where necessary. Agreed specifications are recorded in a form that can be saved, including electronic correspondence.
3.3. The Buyer checks the dimensions they provide, selected options and other details before confirmation. If the Seller identifies inconsistencies or finds that the requested solution is unsuitable for the stated use, it informs the Buyer before agreement.
The Buyer's verification does not remove the Seller's responsibility for its own errors or manufacturing defects.
3.4. Agreed specifications, price or deadlines may be changed only by mutual consent. If the Buyer requests changes after manufacture has begun, the Seller explains whether they are possible and agrees on their effect on price and timing before making them.
Additional work or parts that have not been agreed do not create an obligation to pay for them.
3.5. Manufacture of a standard model after ordering, or selection of standard options, does not in itself mean that the goods cannot be returned. The rules for genuinely personalised goods are set out in clause 6.3.
4. Ordering, price and payment
4.1. Orders are placed through the website, Viber, Telegram, email or telephone at +380 68 659 04 57. Fulfilment requires:
- product and recipient details,
- a contact number,
- payment method,
- locality,
- and delivery branch or address.
The Buyer checks this information and reports errors promptly.
4.2. The Buyer accepts this offer after gaining access to it and agreeing on the goods, price, payment, delivery and timing:
a) on the website, by pressing the button to complete checkout, beside which there is a link to the offer and a clear notice that this action constitutes acceptance;
b) in electronic correspondence, by an unequivocal response, such as “I confirm”, after receiving the order specifications and the text of the offer or a link to it. The Seller's message explains in advance that confirmation means acceptance of these terms.
4.3. For telephone orders, the Seller sends the agreed specifications and offer through an agreed electronic channel for the Buyer's confirmation under clause 4.2. Merely visiting the website or receiving a message is not acceptance.
The agreement is concluded when the Seller receives acceptance; prepayment is not required for this if cash on delivery is selected.
4.4. The Seller sends a confirmation containing seller details, goods and options, price, payment, delivery, timing, and information on exchanges, returns and applicable warranty terms. The accepted offer is provided in a form that can be saved and reproduced without changing its content.
4.5. Prices are stated in Ukrainian hryvnias and include mandatory taxes and charges forming part of the product price. The total price of the selected configuration, or of the agreed specifications for an individual order, is communicated before acceptance.
A price change on the website does not alter the price of an agreement already concluded without the Buyer's consent.
4.6. Payment to the individual entrepreneur's current bank account using the details in section 11 and cash on delivery are available. This offer does not impose mandatory prepayment. If bank transfer is selected, its deadline is agreed before acceptance and stated in the confirmation.
A change of payment method before dispatch may be agreed with the Seller.
4.7. Delivery and cash-on-delivery fees are paid by the Buyer separately from the product price at the rates of the selected carrier and/or payment service provider. The relevant provider calculates its fee; it may depend on the amount and payment method.
Before acceptance, the Buyer can review the cash-on-delivery rates of Nova Poshta/NovaPay and Ukrposhta. The Seller does not impose its own cash-on-delivery fee.
4.8. The Seller sends a receipt or another legally required proof of purchase to the agreed electronic contact without a separate request from the Buyer. Where a transaction must be processed through a cash register or software cash register (РРО/ПРРО), a fiscal payment document in the prescribed form is provided.
Documents are produced and supplied within the statutory periods for the relevant transaction; paper documents may also be provided under the prescribed procedure. An order confirmation does not replace a mandatory fiscal document.
5. Timing and delivery
5.1. Delivery within Ukraine is made by Nova Poshta or Ukrposhta to localities and branches served by the chosen carrier. The Buyer pays delivery at the carrier's rates. The Seller does not perform mounting or installation, and these services are not included in the product price.
- 5.2. Ready-made goods are dispatched within two working days.
- Made-to-order goods are manufactured and handed to the carrier within ten working days: this period already includes dispatch.
The period starts on the next working day after the agreement is concluded, all necessary specifications are agreed and delivery details are received and, for bank transfer, after the funds are credited, whichever occurs later. There is no wait for prepayment when cash on delivery is selected.
Working days for these periods are Monday to Friday.
5.3. Transit time is separate from the dispatch period. An estimated receipt date is communicated before acceptance.
Unless another delivery deadline is expressly agreed, delivery is due no later than 30 calendar days after the agreement is concluded under Article 13(6) of the Law of Ukraine “On Consumer Rights Protection”, provided that the Buyer meets the agreed payment and information obligations on time.
In the event of a delay, the Seller informs the Buyer; changing an agreed deadline requires the Buyer's consent.
5.4. After dispatch, the Buyer receives a tracking number. On receipt, it is recommended to check the packaging, completeness, absence of visible damage and conformity with the order. Where possible, transit damage should be recorded with the carrier's representative and reported to the Seller.
Absence of an unboxing video or carrier's report does not in itself remove statutory rights concerning product defects.
5.5. If the agreed goods cannot be supplied, the Seller informs the Buyer without delay. Substitution of the model, material, colour or contents requires consent. If prepaid goods are not supplied by the agreed deadline, the Buyer may demand supply or return of the prepayment under Article 693 of the Civil Code of Ukraine.
Funds received for an unfulfilled order are not withheld solely because the goods are unavailable.
6. Exchanges, returns and cancellation
6.1. Goods of satisfactory quality may be exchanged under Article 9 of the Law of Ukraine “On Consumer Rights Protection” unless a statutory exception applies to the particular goods.
The general exchange period is 14 days, excluding the purchase date, provided that the goods have not been used and their saleable condition, consumer properties, seals and labels, where supplied, and proof of purchase are preserved as required by law.
If equivalent goods are unavailable, the Buyer may exercise the options under that Article, including terminating the agreement and obtaining a refund. In that case, funds are refunded on the termination date or, if this is impossible, within an agreed period not exceeding seven days.
6.2. Article 13 of that Law applies separately to distance agreements. The general period for notifying termination is 14 calendar days from confirmation of information or receipt of the goods under paragraph 4 of that Article.
Where information has not been properly confirmed, the statutory 90-day period applies; if corrected confirmation is received within that period, the period is 14 days from its receipt. Statutory exceptions apply.
6.3. The right to terminate a distance agreement may be excluded for goods manufactured or altered to individual specifications only under Article 13(5)(3): if those goods cannot be sold to others or can only be sold at substantial financial loss to the Seller.
The individual characteristics and their implications are explained and agreed before acceptance. Manufacture after ordering or selection of standard options is not automatically grounds to refuse a return. Rights concerning manufacturing defects and non-conformity with agreed specifications remain.
6.4. To cancel, exchange or return goods, the Buyer sends their request to info@catelier.com.ua, through the agreed electronic channel or by another legally permitted means, providing information to identify the order. The Seller explains the procedure and return shipping details.
Agreeing on logistics is not permission on which timely exercise of a statutory right depends. Returning physical goods may also constitute termination of a distance agreement under the law.
6.5. On lawful termination of a distance agreement, goods must be kept unchanged, subject to statutory exceptions. Opening the packaging, inspecting or checking the goods does not in itself remove this right.
Screwing the product into place, use by an animal or damage is assessed according to its nature and the specific grounds for the claim, rather than automatically treated as mere inspection. Goods received by post are returned by post using the provided details.
Costs of a lawful distance return are borne by the Seller in the cases established by Articles 12(5) and 13(7) of the Law; the relevant statutory rules apply to other grounds.
6.6. Cancellation and settlement for made-to-order goods take account of applicable law and the agreed specifications. Any prepayment is not automatically deemed non-refundable.
The grounds, amount and timing of a refund depend on the specific lawful claim; defect issues are handled under section 7. For a non-cash refund, the Buyer supplies the necessary payment details. Penalties, fees or expenses are not deducted automatically without a proper legal ground.
7. Quality, defects and repairs
7.1. This offer does not establish an additional warranty period. Obligations concerning quality, safety, service life and warranty arising from law, product documents or the Seller's express advertising commitments as manufacturer remain in effect. Information is provided to the extent required by law.
If no warranty period is set, the Buyer may bring statutory claims for defects discovered within two years of delivery under Article 7(5) of the Law of Ukraine “On Consumer Rights Protection”. This does not mean unconditional free repair of any damage or wear. Other statutory periods for protecting rights also remain.
7.2. If a defect is discovered, the Buyer informs the Seller, describes the problem and provides proof of purchase and other documents where required by law. Photographs may help with a preliminary review but do not replace the statutory verification procedure. The Seller accepts and considers claims under the prescribed procedure.
7.3. On the grounds provided by Article 8 of the Law, the Buyer may request a price reduction, free repair of defects or reimbursement of the cost of correcting them.
For a substantial defect attributable to the manufacturer and confirmed by an expert examination where necessary, the Buyer may choose replacement or termination and a refund. Whether a defect is substantial is determined by law; other lawful grounds and rights remain.
An offer to repair or replace an individual part does not deprive the Buyer of another remedy where its legal grounds are met.
7.4. Manufacturing defects are corrected free of charge, including by repair or replacement of a defective part, if that remedy meets the Buyer's lawful claim. The period for free correction is 14 calendar days from presentation of the goods or another period agreed by the parties. The Seller does not extend it unilaterally.
Delivery for claims concerning bulky goods or goods weighing more than five kilograms and their return are paid by the Seller under Article 8; in other cases, costs are determined by applicable rules. An established warranty period is extended by the repair time as required by law.
7.5. Damage resulting from a proven breach of assembly, installation, use or storage rules is assessed under the law. If the cause of a loss of quality during a warranty period must be established, the Seller arranges and pays for an expert examination within three days of receiving the Buyer's written consent.
Reimbursement of expenses where a Buyer's breach or third-party actions are established, and the right to challenge the findings, are governed by Article 17 of the Law.
Where the Buyer is responsible, paid repair is possible if technically feasible after agreement on the work, price, timing and shipping; additional work not agreed is not payable.
7.6. On lawful termination due to defects under Article 8, funds are refunded on the termination date or, if this is impossible, within an agreed period not exceeding seven days. The amount is calculated under that Article, including its rules for price changes. Replacement periods are governed by Article 8(6).
The relevant statutory periods and procedures apply to other lawful refund grounds.
7.7. Sisal, carpet and other surfaces in contact with claws may naturally wear during intended use. The degree of wear depends on intensity and conditions of use. Normal wear unrelated to a manufacturing defect or non-conformity with the description is not in itself a manufacturing fault.
Premature deterioration or other changes are assessed according to their cause and the agreed characteristics; rights concerning defects remain. A cat's refusal to use a product or its individual behavioural preferences do not in themselves establish a defect; statutory exchange and termination rights are not removed by this.
8. Assembly, installation and safe use
8.1. The Buyer assembles the product, chooses its location and installs it independently or hires a specialist at their own expense. The Seller provides the necessary information and instructions for the particular product.
Absence of an installation service does not remove the Seller's responsibility for the product's proper quality, completeness, safety or instructions.
8.2. Before installation, the completeness, condition of parts and suitability of the location are checked. For wall-mounted models, the wall's material and condition, suitable fixings and load conditions must be considered.
Included fixings are suitable only for the substrate types and conditions specified for them; their inclusion does not mean they suit every wall. If there is uncertainty about the substrate or installation, consult a competent specialist before using the product.
8.3. The product is used for cats according to its purpose and instructions. The stated load for the particular model must not be exceeded, and the structure must not support a person's weight. Installation security is checked before allowing an animal to use it.
Afterwards, the Buyer regularly checks fixings, supports, parts and upholstery and stops use if dangerous damage or loosening occurs until the cause is corrected.
8.4. Cleaning, humidity conditions and other care must follow the instructions and suit the materials of the particular model. Structural modifications or third-party parts are assessed according to their effect on safety and the cause of possible damage.
A defect claim cannot be refused solely because the Buyer installed the product independently where that is intended for the goods; causes and responsibility are determined by law.
9. Personal data
9.1. Individual entrepreneur Предводителева Ніколь is the controller of data received for ordering. Enquiry contacts are in section 11.
9.2. Contact details and order, payment and delivery information are processed to the extent necessary to enter into and perform the agreement, keep records and handle enquiries. Necessary information is shared lawfully with the carriers and payment and technical providers involved.
9.3. When data is collected, the Buyer is given information about its processing and their rights under the Law of Ukraine “On Personal Data Protection”. Details of services, recipients, retention and exercise of rights are set out in the privacy policy available at checkout.
Accepting this offer does not in itself constitute consent to advertising mailings.
10. Liability and enquiries
10.1. The parties are liable for failure to fulfil obligations under Ukrainian legislation. Engaging a carrier or payment provider does not remove the Seller's statutory obligations to the Buyer.
10.2. Extraordinary circumstances are assessed under the law according to their impact on the particular obligation. A party informs the other of the obstacle and takes reasonable steps to reduce its consequences.
Merely referring to martial law, carrier delays or communication disruptions does not release a party from all obligations or legally due refunds.
10.3. Complaints and enquiries are accepted at the contacts in section 11. The parties may resolve a dispute through negotiation; the Buyer's right to contact a competent authority or court and statutory jurisdiction are not restricted. The offer's terms apply while preserving mandatory consumer rights.
